AGU forwards evidence of crime to the STF in disclosure of Twitter Files

A AGU (Attorney General of the Union) sent to the STF (Supreme Federal Court) this Tuesday (April 23, 2024) a news report in which it considers that there was a probable occurrence of a crime against the Democratic Rule of Law and institutions based on data released by journalist Michael Shellenberger in the case that became known as Twitter Files Brazill. The information is a compilation of emails exchanged by Twitter employees (currently X) about Brazilian court decisions involving the social network.

According to the opinion, the posts offend the legal sphere of the Union.”In addition to violating the duty of secrecy regarding documents in custody, they cause unwanted interference in the regular progress of legal proceedings in progress before higher bodies of the Judiciary.”, says excerpt.

The order deals with the disclosure of confidential data from Inquiry No. 4,874, which deals with the acts of January 8th. The document requests that Minister Alexandre de Moraes, rapporteur of the procedure at the Supreme Court, forward the information to the MPF (Federal Public Ministry).

The body will assess whether there was a crime and identify those responsible. The MPF is the body with constitutional competence to propose criminal actions against perpetrators of crimes.

For the AGU, the disclosure via TSE (Superior Electoral Court) on the conduct of those involved in extremist attacks.

According to the text, there was “attempt to break the democratic pillars through the propagation of chaos tending to undermine the reliability of the institutions that make up the Brazilian State, confer on the Union an unquestionable condition of potentially offended in the present case, attracting its interest in the presentation of this news in fact”.
