STF denied the deputy’s appeal regarding a fine of R$30,000 for publishing false information against Lula

Federal deputy Nikolas Ferreira (PL-MG) said this Tuesday (April 2, 2024) that there is no plausible reason for his conviction by the TSE (Superior Electoral Court) for violating electoral law.

The congressman must pay a fine of R$30,000 for disseminating false information against President Luiz Inácio Lula da Silva (PT). Nikolas had appealed to the STF (Supreme Federal Court) to try to reverse the decision, but the Court denied the appeal on March 26.

According to the deputy, he used as a basis the information published by Reinaldo Azevedo in Look when publishing, on your profile in the https://twitter.com/nikolas_dm/status/1775178546018689399?s=20 During the 2022 electoral campaign, Lula diverted R$242.2 billion from public health.

“Will the journalist also be convicted? Will Veja magazine be extinguished like they did with Terça Livre?”, asked Nikolas. He further stated that “it does not matter” who is suffering or not from the fine, since there is no “plausible reason for this conviction”.

Minister Edson Fachin, from the STF, denied an appeal presented by the deputy against the TSE’s decision. The deputy had appealed in 2023. In March of the same year, the TSE decided, by 6 votes to 1, to deny the appeal filed against the decision. Nikolas then appealed to the STF and was ultimately denied.
