247 – The national inspector of justice, Luis Felipe Salomão, is inclined to request the opening of a criminal case against senator Sergio Moro. This decision comes after an investigation in the bodies that coordinated Lava-Jato’s operations: the 13th Federal Court of Curitiba and the 8th Panel of the Federal Regional Court of the 4th Region. Salomão finalized this investigation and forwarded the case to a vote by the National Council of Justice (CNJ).

According to report by journalist Bela Megale, the Federal Police has cooperated with the CNJ in investigating possible crimes that occurred in the financial management of the 13th Federal Court in Curitiba, where Moro played a central role. A partial report issued in August of the previous year by the CNJ denounced a “chaotic management” in the control of resources arising from plea bargain and leniency agreements, approved by Moro himself.

If criminal proceedings are indeed initiated, Moro will face trial by the Federal Supreme Court (STF), due to his status as a senator, which grants him privileged jurisdiction. A possible conviction could even result in the former judge’s ineligibility. The CNJ, according to precedents, maintains the procedures valid even for individuals who are no longer serving as judiciary, especially when there is potential for criminal repercussions, as is the case of Moro.

The investigation carried out by the CNJ adds additional pressure on the Regional Electoral Court (TRE-SP), which is currently analyzing a case that could lead to the revocation of Moro’s mandate. On the first day of analysis of this case, there was an initial victory for the former judge, with the vote of the case’s rapporteur, Luciano Carrasco Falavinha Souza, against the loss of Moro’s mandate.
