After associative work, the Senate plenary approves PL that recognizes the Judiciary as a risky activity

The plenary session of the Federal Senate approved, this Wednesday (8), Bill (PL) 4,015/2023, which recognizes the Judiciary as a permanent risk activity and guarantees protection measures for judges and their families. Judge Eunice Haddad, president of AMAERJ and vice-president of Legislative Affairs of the Association of Brazilian Magistrates (AMB), and association leaders followed the vote in Brasília.

The work of interlocution between magistrates’ associations in Congress was fundamental for the approval of the PL. President Eunice Haddad and other association leaders met with parliamentarians in recent months to highlight the importance of the matter and the fight against insecurity faced by magistrates.

The project had already been approved by the Chamber of Deputies in August 2023. As the text was changed in the Senate, the PL returns for analysis by the Chamber.

To support the preparation of the proposal, recent data were considered that reveal the vulnerability of judges, attested by the study “Profile of the Latin American Judiciary”, conducted by the AMB Judicial Research Center (CPJ). The survey revealed that 50% of magistrates have already been the target of threats to their lives or physical integrity.

The project amends the Penal Code, the Heinous Crimes Law and the General Personal Data Protection Law to recognize the duties inherent to the Judiciary and the Public Ministry as permanent risk activities.

The PL guarantees protection measures, as well as intensifies criminal treatment for crimes of homicide and intentional bodily injury, as long as in the exercise of the function or as a result of it, or against your spouse, partner or relative, including by affinity, until the third degree, due to this condition.
