MPAC investigates act of impropriety committed by councilor when lending vehicle belonging to the Capixaba Chamber

The Public Ministry of the State of Acre (MPAC), through the Capixaba Cumulative Public Prosecutor’s Office, initiated a procedure to investigate the act of administrative improbity committed by the president of the City Council, who is accused of illegally lending a motorcycle belonging to the chamber.

During an action by the Civil Police of Capixaba this Tuesday, 7th, the motorcycle was seized after being seen being driven by a man with no ties to the city’s City Council. The driver stated that he had authorization from the person responsible for the vehicle to drive it.

The Prosecutor’s Office had already initiated the procedure based on another recent case of use of the same vehicle by a person with no connection to the public entity. Information about the approach with a new driver was attached for investigation.

Faced with this new episode, the public prosecutor Vanderlei Batista Cerqueira also sent a letter to the Capixaba District court, requesting information about the criminal record of the man who was driving the motorcycle in this last approach, who, according to information released by the Civil Police, had already was convicted of drug trafficking.

The prosecutor highlighted in the procedure that the conduct of lending the motorcycle for personal purposes constitutes an act of administrative improbity, as established by Law No. 8,429/92, art. 10, XIII, which prohibits the use of vehicles, machines, equipment or materials owned or available to public entities in private activities.
