Regarding the “cashback” forecast for families with an income of half a minimum wage per capita (R$ 706) on their electricity, water, sewage and natural gas bills, and up to 100% on their gas cylinders, the economist states that the measure can benefit around 500 thousand families from Espírito Santo registered with CadÚnico. “This measure is a possibility of increasing income in a very significant way. Families will no longer pay tax on the basic food basket and will receive a refund on gas and energy,” he states.

Another positive surprise in his evaluation was the fact that 0.05% of the tax collected gave rise to two annual draws in the Mega da Virada style. “This will encourage more people to ask for invoices. It was an interesting surprise and could work because larger draws tend to have greater participation from people”, he says.

Important points are in the upcoming projects

With the implementation of the reform, the tax will be charged at the place of consumption, which is less advantageous for sparsely populated states such as Espírito Santo. Therefore, the government and productive sectors are following the debates on the new rules to save the interests of Espírito Santo.

For the State government, some of the important points for Espírito Santo are for the next projects that will also have the role of regulating the reform. This is the case of the IBS Management Committee, the federative transition and the National Regional Development Fund (FNDR), scheduled to enter the next stages.

For Sefaz, in addition to rigorous and refined writing from a technical point of view, the proposed regulation implements the simplification of the tax system promised by the reform and preserves the autonomy of federative entities on important topics, such as the setting of IBS rates and regulation cashback (personalized tax refund).

Even so, the secretariat assesses that, on the other hand, it can already be seen that the regulation of the Tax Benefits Compensation Fund deserves improvements, in order to increase the margins of legal security for companies that currently receive ICMS tax incentives, which will be progressively reduced between 2029 and 2032 until their extinction.

Sefaz also highlights that important issues for Espírito Santo were left for a second stage of regulation.

“The PLP addresses most of the issues delegated by Constitutional Amendment No. 132/2023 to complementary legislation, but does not exhaust the regulation of tax reform. Topics of marked importance – such as the IBS Management Committee, the federative transition and the National Fund Regional Development (FNDR) – were not included in this first project. The federal government has already announced that, in the coming weeks, it will forward to the National Congress another PLP dealing with matters not covered at this stage”, details the secretariat.

The State government, through Sefaz and together with the Espírito Santo benches in the Chamber of Deputies and the Federal Senate, highlighted that it will closely monitor the parliamentary debates and will present all the necessary studies and proposals to safeguard the interests of Espírito Santo, throughout of this process.
