Public Ministry recommends removal of statue of Daniel Alves in Bahia

The Public Ministry of Bahia (MPBA) recommended this week that the administration of the city of Juazeiro (BA) remove the statue of former player Daniel Alves from the center of the municipality. The suggestion is due to the law that prohibits tributes to living people made for public good. The statue was vandalized with sticky tape following the conviction of Daniel Alves for rape in Spain.

The recommendation is to investigate a complaint received by the Public Ministry on March 25 of this year, and follows a procedure initiated by prosecutor Daniela Baqueiro.

According to Baqueiro, “the municipal administration sent to the MP a copy of Administrative process nº 295/2019, Auction nº 137/2019 and the payment processes referring to the acquisition of the statue of Daniel Alves, which attest that it is a public asset acquired with resources public, and it is not permitted to honor a living person with a public good”.

It is up to the municipality to provide for the name, numbering and registration of public places, and the use of the name, surname, or surname of living people is prohibited, in accordance with the Organic Law of Juazeiro. Furthermore, article 21 of the State Constitution of Bahia and Federal Law number 6,454/1977 prevent the attribution of names of living people to public assets.

In the MP document, a period of 30 days was determined for the city to justify compliance with the recommendation and provide proof of regularization of the situation. In September last year, the monument located in Juazeiro was vandalized. Adhesive tape and a trash bag were placed over the sculpture’s head.

On December 30, 2022, a 23-year-old woman reported having been abused by Daniel Alves, at the Sutton nightclub, in Spain.

Daniel Alves was sentenced to four and a half years in prison, in addition to five years of supervised release. The judge in the case, Isabel Delgado, also stipulated that compensation of 150 thousand euros be paid and ordered that Daniel Alves stay away from the victim for nine years. The procedural costs will also be borne by Alves.

In testimony during the hearing that sealed his conviction, Daniel Alves cried, said he had drunk alcohol and denied that he had raped his wife. Convicted of rape in Spain, the former full-back left Brians 2 prison after paying bail set at 1 million euros (around R$5.45 million, at current rates).

The former player had been in prison since January 2023. Therefore, Daniel’s defense filed a request for provisional release on April 19, claiming that a quarter of his sentence had already been served.
