Court grants injunction to guarantee security around building in Chapecó

After complaints from residents of a neighboring building and a request from the Public Ministry of Santa Catarina (MPSC), the City of Chapecó, in the west of Santa Catarina, embargoed the construction work of a high-standard building in the city center. There are reports of materials falling, such as pieces of wood and ceramics, including near a school.

In addition, there is a court case related to the building. The 1st Public Finance Court of Chapecó decided that the construction company must guarantee security around the building. The decision is due on Tuesday (23) and can be appealed.

The building being built is of a high standard, with four elevators, solar energy panels, party spaces, toy libraries, bicycle racks and parking spaces with infrastructure for electric vehicles.

Regarding the embargo, Chapecó City Hall clarified in a note that it carried out the total ban following a request from the MPSC “allowing only the services essential for the elimination of infractions”. If the construction company does not comply with the embargo, it will pay a fine of R$5,500.

The legal action was taken by the Public Ministry of Santa Catarina (MPSC). According to the process, materials such as wood and ceramics fell from the work.

A resident of a neighboring building reported that her apartment window was broken by loose objects from the construction site in March.

The following month, other people in the same building said that pieces of wood hit the place and a roof had to be replaced because of falling objects.

In addition to the reports from the residents of this building, the MPSC added results of Civil Defense inspections to the process.

According to the process, “Civil Defense found that the work was missing trays and protective nets, posing a high risk in the event of windstorms and with the possibility of materials being released from around the work site.”

In relation to the school, the local prosecutor reported a piece of concrete falling, hitting the institution’s awning. Furthermore, according to the process, “it came to the attention of the Public Prosecutor’s Office that an object had fallen from the crane, putting people passing by at risk.”

In the action, public prosecutor Cristiane Weimer said that, despite being aware of the existing safety problems, the municipality allowed the work to continue, always offering deadlines for adaptation, which were repeatedly breached by the construction company.

“Despite the defendant’s frequency of failing to comply with safety standards during the execution of the work, in total disregard for the community (people who pass near the site and neighbors), to date only two Infraction Notices have been generated for non-compliance with safety standards. security”, considered the prosecutor in the action, highlighting the value of each fine, R$ 3,751.72 each, not paid until the action was filed and the amount considered derisory by the representative of the Public Ministry.

In view of this, judge Rogério Carlos Demarchi granted an injunction (temporary decision) so that the construction company adopts minimum safety measures, under penalty of a daily fine of R$20,000.

For the city hall, the measures ordered by the Court are to embargo the work whenever safety standards are not being met by the construction company.

The Municipal Administration informs that it carries out routine inspections of the works. In relation to the building mentioned by the MP, the City Hall had already carried out monthly inspections for over a year, notified the company about adjustments and partially embargoed the work on April 19, so that the owner could arrange for the adaptation of the facade screens on the construction stages. plastering of the East, West and South facades.

Upon request from the Public Prosecutor’s Office, City Hall determined that the work would be completely embargoed, allowing only the services essential to eliminate the infractions. Failure to comply with the embargo will result in a fine of one thousand Municipal Reference Tax Units (R$5.56 thousand).
