Family of nurse who died of Covid while working in Acre wins R$200,000 in compensation

The family of nurse Clairton Lima Mendonça, who worked at the Emergency Room in Rio Branco, and died in early June 2021, a victim of Covid-19, is one of the first families in Acre to benefit from a law that requires the Union to financially compensate those healthcare professionals and workers who have become permanently unable to work or have died due to the pandemic.

The law includes health professionals and workers, ranging from doctors to support staff in establishments.

Clairton, who was 50 years old and died in the PS, where he worked for two decades.

The sentence, handed down by the Federal Judge of the 1st Court of Acre, Wendelson Pereira Pessoa, this Wednesday, 24th, determines that the Union pays a total of R$ 200 thousand to the family. According to the judge’s understanding, the family proved that Clairton maintained a link with Sesacre, working on duty in the PS as a nurse until June 2021, when he died from complications from Covid-19.

The judge also states in his decision that the death occurred during the state of emergency and that the professional worked in an urgent and emergency service, highly exposed to occupational risk of contagion.

The Federal Court decided that the widow and an older daughter will be compensated R$50,000. The middle daughter, who was 16 years old in the year of her father’s death, will receive another R$55,000. The youngest son, who was 10 years old when Clairton died, should receive compensation of R$100,000.

The family was represented by lawyer Roraima Rocha, from MGR Advogados. To ac24horas, Rocha states that although the law has existed for a few years, it is unknown to society. “It is a law that benefits the family of those who lost a loved one during the direct fight against the pandemic and even benefits them in the event of incapacity. Unfortunately, many families do not know they are entitled,” she explains.
