Union tax will not be approved in the Chamber, says Lira

The president of the Chamber of Deputies, Arthur Lira (PP-AL), stated this Wednesday (April 24, 2024) that a bill that deals with the return of the union tax will not be approved in the Lower House. The topic is of interest to the Minister of Labor, Luiz Marinho, who wants the imposition of a “compulsory contribution” from workers to unions.

“When this matter goes to plenary it has no support, there is no support for land invasion, for changing laws through decrees, ordinances or projects”stated Lira, during a debate held by CACB (Confederation of Commercial and Business Associations of Brazil).

Lira made it clear that Congress has the majority of representatives as conservatives and liberals and that he will not approve what he considers to be “setbacks”, either in his administration or in that of his successor –if his nominee is elected– in the presidency of the Lower House .

“I spoke with Minister Marinho and told him that if the Chamber plenary smells that he is wanting to change the labor reform or return some issues that Congress does not vote on, through resolutions, regulations and decrees, the PDLs will to the plenary and we will overturn it”declared the deputy.

The union tax was abolished in 2017 during the government of Michel Temer (MDB) with the labor reform (Law 13,467) and, since then, the contribution has become optional. However, the charge is now made in advance, and it is up to the non-unionized worker to inform that they do not intend to cooperate.

In September 2023, the STF (Federal Supreme Court) ruled on the constitutionality of charging assistance contributions from non-union members in the event of an agreement, collective bargaining agreement or court ruling. Even so, the Court understood that the worker has the right to oppose the charge, as long as “made expressly”.
