Paulo Martins says he does not know the fate of the Senate seat if Moro is impeached

Former federal deputy Paulo Martins (PL-PR), who came second in the race for the Senate in Paraná, told the column Between the lines who does not know what will happen if the Superior Electoral Court (TSE) revokes the mandate of Sergio Moro (União – PR). Martins received more than 1.6 million votes in the election and could directly benefit if the appeal of the Liberal Party (PL) and the federation formed by PT, PCdoB and PV is victorious in the TSE. “There is great legal uncertainty in this case,” he says.

Martins cites similar cases in which it was decided that the second-placed candidate would enter provisionally while a new election would be held. He also pointed to another example, when the Federal Supreme Court (STF) decided that no one would occupy the vacancy, which, for him, would create an imbalance between the federations, because Paraná would have one less name. He also explains that there is another legal theory that says that, if someone has votes annulled, the second-placed person takes over directly. “So, we really don’t know what will happen”, he concludes. The Regional Electoral Court (TRE) of Paraná acquitted Moro at the beginning of the month. An appeal can now be made to the Superior Electoral Court (TSE).
