TCE-MS regulates application of the federal law on access to information

Through TCE-MS Resolution No. 211, of March 27, 2024, the Court of Auditors of the State of Mato Grosso do Sul regulated access to public information produced or held by the Court of Auditors. The resolution is published in the Official Electronic Gazette this Monday, April 1st, DOE n. 3703.

The measure aims to promote even greater transparency in public administration by guaranteeing access to information provided for in item II of § 3 of art. 37 and in § 2 of art. 216 of the Federal Constitution.

The resolution established the guidelines that will be observed to guarantee the fundamental right of access to information within the scope of the TCE-MS, such as: “observance of publicity as a general precept and secrecy as an exception; II – the dissemination of information of collective or general interest on the world wide web, for public access; III – responding to requests for access to information sent to the Court’s Ombudsman’s Office; IV – the provision of means so that the interested party can consult information of collective or general interest, as well as request information, in accordance with this Resolution, by filling out an electronic form; V – other forms of disclosure indicated in an act by the President of the TCE-MS, among others.

Access follows the requirements of the Access to Information Law (Law No. 12,527) which provides that anyone can request information from public bodies, without providing justification, “and must address it to the Court Ombudsman’s Office through the following means: I – electronic , on portal II – by email https://www.tce.ms.gov.br/ouvidoria/sic/#!/; [email protected]; III – by correspondence addressed to the TCE-MS Ombudsman, at the following address: Av. Des. José Nunes da Cunha, block 29, Campo Grande/MS, CEP: 79031-310”.
