Pet shop must pay R$10,000 to the owner of a dog that died after being crushed by a 3,000-liter water tank | Acre

The pet shop GH Veterinária, in Cruzeiro do Sul, in the interior of Acre, was ordered to pay R$10,000 to the owner of the dog Tina, who died after being crushed by a water tank weighing approximately 3 thousand liters. The case occurred in May 2023.

The decision of the Special Civil Court of the District of Cruzeiro do Sul was released this Monday (1). According to the Acre Court of Justice (TJ-AC), judge Rosilene de Santana, who judged the case, understood that those responsible for the pet shop were negligent.

“The defendant did not adopt the necessary precautions to maintain the physical integrity of the animal, due to the lack of adequate structure for the activity it carried out, allowing the dog to die while it was under its care”, says the decision.

Tina, a poodle dog, had been left at the pet shop by hairdresser Thamilis Regina, her owner. The animal should take a bath, undergo a grooming session and undergo treatment against ticks. The management of the establishment advised that the animal remained there for treatment until the following day, on Friday, March 19th.

Tina was placed outside the pet shop, where the suspended water tank and kennels were located, at night so that the ticks would not spread to other rooms. The management of the establishment confirmed that the place was used for this purpose, however, they claimed that it was an accident and that the structure that held the box sank and fell on top of the animal.

“I left my phone and they said they would take care of her. She slept there, stayed out in the open, stayed in the back area under the water tank. In the morning, he sent me saying that this had happened. The water tank collapsed and crushed her. They did this to my dog, the box even fell along with a wooden structure,” Thamilis told g1 at the time of the case.

The hairdresser added that she didn’t have the courage to go and see the animal and the pet shop arranged the burial.

The person responsible for the pet shop, George Andrade, explained that there are three kennels on site and Tina was not trapped with the other animals due to ticks. According to him, there were no signs that the structure with the water tank could fall.

“The building is rented. The foot of the water tank sank and, unfortunately, at the time it happened it was close to the water tank. It was an accident”, he pointed out.

Andrade highlighted that he told the hairdresser that he had removed the dog from under the structure and if she would like to see it. “She said she didn’t want to see it. I asked if she could bury it, she said yes,” she summarized.
