Businessman Fernando Sastre de Andrade Filho, aged 24, could be temporarily arrested on the night of this Monday, 1st, after giving testimony at the 30th DP (Tatuapé) about the accident he caused in the early hours of Sunday, 31st, on Avenida Salim Farah Maluf, in Tatuapé, in the east zone of São Paulo.

Andrade Filho was driving a 2023 Porsche valued at more than R$1 million. Images of the accident indicate that it was above the maximum speed allowed on the road, which is 50 km/h.

He crashed into the back of a white Renault Sandero that was driven by app driver Ornaldo da Silva Viana, 52 years old. Viana died, and a passenger in the vehicle was injured.

Andrade Filho fled the scene with the help of his mother, who told the military police officers who responded to the incident that she was going to take her son to the hospital.

Although the case was initially registered as culpable homicide (without intention to kill), police chief Nelson Vinícius Alves, from the 30th DP, decided to indict Andrade Filho as the author of homicide with possible intent, which is characterized when the person assumes the risk of killing . High speed is the aspect used by the delegate to characterize possible intent.

“He used the car as a weapon,” said Alves after the driver’s statement.

At 7pm this Monday, the driver remained at the police station and the police chief was awaiting the Judiciary Duty’s decision on the request for temporary arrest.

According to the delegate, Andrade Filho will also be charged with failing to provide assistance and causing bodily harm to the other occupant of the Sandero, the passenger Viana was transporting.

The driver’s mother will not be charged with helping her son escape the scene of the accident because, according to the driver, personal favoritism practiced by a family member does not constitute a crime.

The police chief stated that the mother did not take her son to any hospital, as she initially claimed – she just removed him from the scene of the accident, to prevent him from being taken to the police station and subjected to an examination that could indicate drunkenness, for example.

The conduct of the military police officers, who let the driver go, will also be investigated, but by the Military Police themselves. The delegate made it clear that the Civil Police will not deal with this issue.

The speed at which the Porsche was traveling at the time of the accident will be indicated by the expert. Due to the hours that have passed since the accident, no test will be able to prove that the driver was possibly drunk.
