A Tax reform enacted at the end of last year paved the way for states to extend the collection of Motor Vehicle Ownership Tax (IPVA) to vessels and aircraft. In Rio, a proposal is scheduled to be voted on in the Legislative Assembly (Allerj) in the first semester. It establishes that the charge will be based on the vehicle owner’s place of residence, and that the tax amount can reach 4% of the value of the asset. If approved, the new tax should inject into state and municipal coffers R$600 million per year. If sanctioned by the end of September, the new tax could come into force in 2025.

According to a report from the newspaper O Globo, data from Port authority show that the state of Rio has more than 110 thousand registered vessels, with 34 thousand speedboats, 8.6 thousand jet skis, 6.6 thousand sailboats and 214 yachts. On sales websites, a yacht in Angra dos Reis, on Costa Verde, is sold for R$20 million. According to the National Civil Aviation Agency (Anac), are registered and authorized 789 aircraft.

The proposal, authored by state deputy Luiz Paulo (PSD), has already passed through the House’s Constitution and Justice Committee (CCJ), but still needs to go through two votes in the plenary. If deputies present amendments to the project, it will return to CCJ. The proposal provides that planes and boats that use fossil fuels will pay 4% of its value. Those powered by renewable energy would be taxed at 3% per year. For cars, motorcycles and trucks, the IPVA rate varies according to the vehicle type. Passenger cars, for example, pay 4% of their value, and motorcycles, 2%.

According to the project, there will be exemptions. In the airline sector, owners of aircraft used in agricultural activities nor those who provide services to third parties, such as companies and air taxis. For the naval sector, vessels owned by legal entities authorized to provide water transport services, artisanal fishing boats or industrial and maritime platforms (such as oil platforms) will be free from the charge.

The percentage, according to the Boat Builders Association (Acobar), should be calculated according to the boat’s power and not its size. The entity has participated in meetings to discuss the topic. Another difference is that, while cars and motorcycles are exempt from tax upon reaching 15 years of manufacture, the project defines that only vessels with over 30 years and aircraft aged 50 years or more.
