The Santa Catarina property registry offices have already regularized more than 30 thousand housing units in the State through Reurb – Urban Land Regularization. The numbers, recorded since the law was sanctioned in 2017, show that 30,851 homes were regularized in Santa Catarina, which corresponds to 4.7% of the country’s total. Analyzing the number of processes, Santa Catarina’s performance is even better: 12.90% of the Brazilian total.

Reurb was established by Law no. 13,456/17 as a set of legal, urban planning, environmental and social measures aimed at incorporating informal urban centers into urban territorial planning and titling their occupants. “The rate of land irregularities in Santa Catarina is one of the lowest in the country. And, even in this condition, Santa Catarina has one of the best regularization rates, which demonstrates great dedication to the topic”, says the president of the Association of Notaries and Registrars of the State of Santa Catarina (Anoreg/SC), Otávio Margarida.

Even with the positive results, there is an understanding that greater stimulus to society is also necessary. Therefore, a proposal is being created to carry out the Land Regularization Caravan, bringing together actors who can contribute to making these numbers even better. The idea is to travel through eight macro-regions of the State, promoting events with representatives from CORI (College Registral Imobiliário), property registrars, FECAM, Crea-SC and the Court of Justice of Santa Catarina.

The regularization process has two main actors _ the municipalities and the property registry offices. The City Hall is responsible for the process, identifying environments that can be classified as consolidated informal urban centers, indicating the residents and possible structural, urban and environmental improvements. The registrar carries out the legal qualification of all documentation and registers land regularization. Then the title document is created for each of the residents, that is, the real estate registration certificate.

The deadline for regularization depends on the process sent by the Municipality. Notary offices have deadlines set by law. There are 20 days for legal analysis and formalization of the opinion and another 60 days for registration. “But we have cases in which the entire procedure was carried out in 40 days, from arrival at the registry office to the completion of services”, comments the president of Anoreg/SC.

For Otávio Margarida, the person who gains most from Reurb is society. “Among the positive aspects we can highlight the legal security and dignity of the beneficiaries. There are also urban gains for cities, with more organized locations, and also tax gains, because after receiving the property title, the person can sell the property and legally transfer the asset, generating tax collection”, he points out.​
