Porsche driver becomes defendant, but court denies arrest request in SP

MP says that the businessman pressured his girlfriend to deny that he was drunk when he drove a Porsche to justify the arrest request. “From the moment of the accident, there was a clear intention of the accused and his mother to try to reduce the seriousness of the events by hiding the driver’s drunkenness and removing his flagrant state to compromise the investigations”, cited prosecutor Ratton.

Judge refuted the prosecutor’s position. “This is an unfounded conclusion, without any connection with the other cognitive elements that authorize such a conclusion”, countered magistrate Cintra.

The Porsche driver must present his defense within ten days, according to the Court. The decision also gives a period of 15 days for the inclusion of expert reports on the case requested by the MP; orders the Civil Police to include new documents requested by the Court, which will be added to the process, and authorizes the testimony of firefighters who participated in the incident.

Justice will also analyze the medical records of the victim’s friend. He was in the passenger seat of the Porsche and was injured in the accident.

The prosecutor asked for preventive detention, to prevent the businessman from influencing witnesses “as he has done throughout the investigations.” The TJSP (São Paulo Court of Justice) informs that the case is being processed in secret.

There are no legal reasons, at least for now, why today, given the absence of evidence of obstruction of criminal investigation, [a prisão preventiva] be decreed. The MP’s arguments have no connection with the reality of the case, and seek their justifications in abstract presumptions and fears.
