Senate approves new DPVAT and extra credit of R$15 billion

The Senate approved, this Wednesday (8/5), the basic text of Complementary Bill No. 233/23, which resumes the collection of Mandatory Personal Injury Insurance for Land Motor Vehicles (DPVAT). The proposal had 41 votes in favor, 28 against and no abstentions. Now, the text goes to presidential sanction or veto.

The former DPVAT, extinguished during Jair Bolsonaro’s government, will be called Mandatory Insurance for the Protection of Traffic Accident Victims (SPVAT), which will be charged to owners of new and used cars to pay compensation for accidents. According to Senator Jaques Wagner (PT-BA), government leader in the Senate, a survey by the Ministry of Finance indicates that the SPVAT should cost the driver between R$50 and R$60.

After approval of the base text, the senators analyzed the highlights of the amendment included in the project that anticipates R$15.7 billion in credit to the government. The Upper House accepted the “jabuti” by 43 yes votes and 26 no votes. With this, President Luiz Inácio Lula da Silva will be able to allocate part of this amount to the payment of commission amendments.

The approval of the new Dpvat was one of the conditions for holding the Congress session to analyze presidential vetoes, scheduled for tomorrow (9/5). The overturning of the veto on the section of the 2024 Budget that determines the payment of R$5.6 billion in commission amendments.

After negotiations, Planalto and Congress reached an agreement to reduce the value of the amendments to R$3.6 billion. However, even with the R$2 billion cut, the government would still encounter difficulties in making the payment without harming public accounts and, therefore, the Legislature agreed to approve the Spvat.
