Senate approves return of DPVAT and release of R$15 billion for Lula government

The Senate approved this Wednesday (8) the project that recreates the mandatory insurance to protect victims of traffic accidents, the DPVAT, and the release of R$15 billion for the Lula (PT) government. The vote was possible after an agreement between the senators. The proposal was approved with the minimum number of votes necessary, the score was 41 to 21.

Complementary Bill (PLP) 233/23 was presented by the Executive. Now, the text goes to presidential sanction. The senators rejected all the highlights that intended to change the approved basic text.

The DPVAT was extinguished under the government of former president Jair Bolsonaro (PL), in 2020. At the time, the Executive argued that the measure aimed to prevent fraud and alleviate the costs of supervision and regulation of insurance by the public sector, in compliance with a recommendation from the Federal Audit Court (TCU).

Since 2021, Caixa Econômica Federal has operated insurance on an emergency basis after the dissolution of the consortium of private insurance companies that managed DPVAT.

The new DPVAT will be renamed SPVAT (Mandatory Insurance for the Protection of Traffic Accident Victims) and will be administered by Caixa. Motor vehicle owners must make payment once a year.

According to senator Jaques Wagner (PT-BA), rapporteur of the proposal and leader of the government in the Senate, the rate will be between R$50 and R$60, from 2025. The value will be defined by the National Council of Private Insurance (CNSP ).

“Jabuti” in the project will advance R$ 15.7 billion to the government

Parliamentarians added a “jabuti” to the DPVAT project, jargon used in Congress for a subject that has no direct relationship with the initial theme of the proposal, to advance R$15 billion to the federal government. During this afternoon’s session, opposition senators spoke out against the inclusion of credit.

The amount may be used to pay for committee amendments, mainly before the analysis of presidential vetoes, scheduled for Thursday (9). In January, Lula sanctioned the 2024 Budget with a veto of R$5.6 billion to parliamentary committee amendments.

The current fiscal framework authorizes the release of resources to the government only after the second bimonthly result with higher-than-expected revenue. With approval of the project, the amount will be anticipated.
