Opinion is part of action in which family members request compensation of R$5 million for moral damages
The Public Ministry of São Paulo defended the payment of pensions for businessman Fernando Sastre de Andrade Filho24 years old, to the family of app driver Ornaldo Silva Viana, 52 years old, killed in car accident with Sastre, who was driving a Porsche in the east zone of São Paulo.
The statement was published in a lawsuit filed by the victim’s family, who are asking for compensation of R$5 million as moral damages. The opinion of prosecutor Fernando Bolque, however, only concerns financial support.
He argues that the Court grants an injunction obliging Sastre to pay three minimum wages (R$4,236) per month to the family until the case is closed.
An expert opinion showed that Sastre was driving the vehicle at 156 km/h when he crashed into the car driven by Viana. The permitted limit for the road is 50 km/h.
The businessman, who is defendant for intentional homicide and serious bodily injuryhanded himself in to the police at the beginning of the week and is preventively arrested. After a custody hearing this Tuesday, the 7th, he was transferred to the Provisional Detention Center 2 of Guarulhos, in Greater São Paulo.
On the same day, the ministers of the Fifth Panel of the Superior Court of Justice denied the defense’s request for freedombut authorized the transfer to the Tremembé Penitentiary, in the interior – a unit that usually receives convicts in cases of national repercussion.
