In a decision on Tuesday night (7), the second-degree judge of the Court of Justice of Santa Catarina, Alexandre Morais da Rosa, prohibited the State government from dismissing temporary teachers and deducting the days stopped until there is an analysis by the Judiciary. on the legality of the ongoing strike. The order was signed at 8:23 pm.

The conclusion states:

“For these reasons, I DEFEND in part the injunction for the authority to refrain: [1] to dismiss the ACTs until the mandamus has been judged definitively, under the scrutiny of the adversary system, readmitting those eventually dismissed; It is, [2] to deduct the days stopped until the preliminary and/or merit declaration regarding the legality of the strike movement, without prejudice to the retroactive discount in case of declaration of illegality”.

The request was made by Sinte, the category’s union. For the judge: “Thus, the imposition of administrative sanctions due to adherence to the strike movement is prohibited. For these reasons, the injunction must be partially granted to order the defendants to refrain from dismissing the civil servants [temporários ou efetivos] due to absences during the strike period, reinstating those eventually dismissed until the legality and extension of the wall movement is judged”.

The preliminary decision can still be appealed.
