According to the decision, Marcio’s defense claimed that his preventive detention was wrongly ordered and that the person who appears in the camera images was, in fact, Márcio’s brother.

“I no longer see the presence of hypotheses that justify maintaining the accused’s preventive detention, because there is not enough evidence of authorship”, says an excerpt from the document.

The Public Ministry also asked the payment of more than approximately R$2 million in favor of family members of the victim Pilson Pereira da Cruz (R$ 1 million), Rui Luiz Bogo (R$ 700 thousand), José Roberto Domingos (R$ 150 thousand) and another person who was a victim of the attack.

It is up to the Court to analyze the complaint and decide whether or not to accept the requests.

Ines, Bruno, Eder and Márcio have been arrested since April 23, two days after the crime.

Mother and son are suspected of killing elderly people

Images from two security cameras show that at least eight people were in the house when the woman entered shooting (watch above). The son went to the backyard and also fired shots. Ines, who appears in a blue blouse, had a pistol, and Bruno, in white, had a 12-gauge shotgun.

In another part of the video, mother and son appeared running away, carrying firearms.

For the police, who are still investigating the case, the suspicion is that the motivation for the crime is a commercial disagreement involving rent payments for the invaded house.
