TSE suspends revocation judgment against Jorge Seif and determines to obtain more data | Policy

The Superior Electoral Court decided this Tuesday (30) complement the production of evidence in the appeal that discusses the request for impeachment of senator Jorge Seif (PL-SC) for abuse of economic power in the 2022 campaign.

By 6 votes to 1, the ministers approved the proposal made by the rapporteur, Floriano de Azevedo Marques, to open a deadline for searching for data on the alleged irregular use of the structure of businessman Luciano Hang’s stores, such as air transport, in favor of Seif campaign.

Therefore, Hang’s company will have 48 hours to inform all aircraft that were available at the time. Next, the TSE will consult aerodromes to verify the landings and trajectories of these aircraft.

According to the rapporteur, the judgment of a revocation request requires robust evidence, with effective proof of an act, as it involves very serious sanctions.

“Analyzing the records in detail, it is clear that the production of evidence in relation to the set of facts that the author and the magistrate judge did not carry out the burden and responsibility of pursuing sufficient evidence to reach a firm and safe conclusion”, said the rapporteur.

The Electoral Inspector General, Raul Araújo, voted against the so-called opening of due diligence because he considered that the measure represented the reopening of the production of evidence in the appeal phase.

The ministers analyze an appeal by the Bora Trabalho coalition (PSD, Patriota and União Brasil) against the decision of the Regional Electoral Court of Santa Catarina (TRE-SC), which rejected the revocation.

Opponents accuse Seif of having his campaign for the Senate favored by businesspeople and a union in the state, in a way that was not declared to the Electoral Court, to boost the vote. The politician has always denied the accusations.

According to opponents, the abuse of economic power was characterized by:

• irregular donation of a helicopter owned by Osni Cipriani for campaign trips;
• use of the structure of businessman Luciano Hang’s stores, such as air transport, official company channels to publicize the campaign, recording room for live streams, videos for social networks and involvement of employees in promoting the candidacy; It is
• alleged financing of electoral propaganda by a union.

For the Electoral Public Ministry, the link between candidate Jorge Seif and businessman Luciano Hang caused an imbalance between the candidates competing for a seat in the Senate in 2022.

Jorge Seif’s defense argued that the evidence included in the action does not prove the use of aircraft, the marketing structure and personnel of Lojas Havan.

Luciano Hang’s lawyer, Sidney Sá das Neves, denied that the company had made aircraft available for Seif’s campaign. He also denied that the marketing structure was made available to the candidacy.

In addition to Seif, the following are also targets of the action:

• the substitutes on the ticket, Hermes Artur Klann and Adrian Rogers Censi;
• footwear businessman Almir Manoel Atanazio dos Santos;
• businessman Luciano Hang, owner of Havan.
