Man is convicted of killing his partner and raping his stepdaughter in SC – OCP News

A man was sentenced this Monday (29) to more than 64 years in prison for killing his partner and raping and trying to kill his 13-year-old stepdaughter in Bombinhas, on the North Coast of Santa Catarina. According to the Public Ministry of Santa Catarina (MPSC), Joelma Bonifácio de Andrade was stabbed 10 times and died after spending more than a month in hospital.

The crimes took place in the early hours of February 4, at the family home, located on Zimbros beach. According to the investigation, Joelma woke up to the screams of her daughter, who was being raped and threatened by the suspect. The woman tried to protect the girl, but was stabbed by her partner.

Seriously injured, Joelma was admitted to the Ruth Cardoso Hospital, in Balneário Camboriú, but she did not survive her injuries and died on March 8, 2023 – on International Women’s Day -, just over a month after being stabbed.

At the time, the MPSC charged the man with rape of a vulnerable person against his stepdaughter and two attempted murders (against the mother and the girl). On March 14, the 2nd Public Prosecutor’s Office of the District of Porto Belo made an addition to the complaint, which occurs when the Public Prosecutor adds a new element to the criminal action after the complaint has been offered to the Court.

With the addition, the public criminal action changed to completed homicide with five qualifications in relation to the girl’s mother: feminicide, foul motive, resource that made the victim’s defense difficult, cruel means and commitment to secure an advantage over another crime. In relation to the child, he was reported with the same qualifications for attempted feminicide, aggravated by the fact that the victim was under 14 years old and was his stepdaughter.

Judgment

The man was taken to the popular jury this Monday (29), and the Porto Belo Sentencing Council considered all the arguments of the Public Ministry of Santa Catarina (MPSC) to sentence him to more than 64 years in prison, under a closed.

The defendant – held in the Tijucas Regional Prison – was sentenced for murder, with the qualifications of a base motive, a cruel means, a resource that made the victim’s defense difficult and, to ensure the execution, impunity or advantage of another crime, and feminicide, for kill his companion, the girl’s mother. Regarding the crime committed against Joelma, the jurors sentenced the defendant to 24 years in prison.

In relation to crimes against children, the defendant was convicted of attempted murder, qualified by cruel means, a resource that made the victim’s defense impossible, to ensure the execution, impunity or advantage of another crime, feminicide, adding the fact that the crime having been committed against a minor under 14 years of age (Henry Borel Law), and the rape of a vulnerable person on numerous occasions, with the aggravating factor of being the girl’s stepfather.

The total sentence was 40 years, eight months and 27 days, leading to a sentence of 64 years, eight months and 27 days in prison. The defendant was also ordered to pay a minimum compensation of R$30,000 to his partner’s family.
