Jutay project recognizes transplant patients as people with disabilities

Transplant patients often do not have their restrictive conditions admitted. Even after surgery, these patients require periodic medical assistance and need to use various medications. As the limitations of certain diseases and related conditions are not identified, the existence of limitations to full social inclusion is not recognized. To bring rights to this public, deputy Jutay Meneses (Republicans) presented Bill 2,043/24 to the Legislative Assembly of Paraíba (ALPB), which recognizes transplant patients as people with disabilities.

According to the project, it is recognized that patients undergoing transplant surgery will have the same rights as people with disabilities, without prejudice to biopsychosocial assessment, when necessary, if the medical report prepared by the attending physician, responsible for the treatment and monitoring of the patient , conclude that there is a chronic clinical condition that promotes long-term impairment of a physical, mental, intellectual or sensory nature, which, in interaction with one or more barriers, may obstruct their full and effective participation in society on equal terms with others people.

“The project is important, as we must consider that, even after many years, there is a risk of losing the transplant, hence the need for lifelong medical monitoring. And even after all possible therapeutic care, rehabilitation may not be complete. This is just one of the reasons that justify the need to include in legal text the possibility of these patients being equated with people with disabilities”, he noted.

Deputy Jutay Meneses also highlighted that transplant surgery is not a cure, but rather a treatment. Transplant recipients become chronic patients and need to use immunosuppressants for life. “The perception of the needs of these individuals so that they can live in equality is fundamental for guiding support policies that promote better conditions for the integration of these people into society,” he said.
