This Tuesday (30th) the deadline for companies with ICMS debts registered in active debt to join the Agreement Paulista program ends. Created by the Attorney General of the State of São Paulo (PGE/SP) to qualify the state tax transaction, the program reached the mark of R$7.3 billion last week. The amount already exceeds the initial revenue forecast of R$4.4 billion, announced at the end of last year.
Since the launch of the first notice, on February 7, aimed exclusively at ICMS debts registered in active debt, the program’s balance shows that since the launch of the notice, R$413 million has already been collected for the state’s coffers.
To date, there have been more than 5,200 accessions celebrated. Of these, approximately 4 thousand are agreements for payment within five years.
The ICMS negotiation notice provides for a 100% discount on late payment interest and 50% on the remaining debt, including fines of any kind, interest and legal charges. As long as there is no reduction in the principal amount of tax due.
In relation to ICMS, the prosecutor’s office promoted meetings with businesspeople and tax experts to present the program in the capital and in the main economic hubs in the interior of the state, answer questions and listen to suggestions, with the aim of increasing adherence and also avoiding judicialization.
Payment can be made in 120 months. Part of the debt can be paid with court orders and accumulated ICMS credits from own or third parties. The agreement is formalized with the payment of the first installment, the value of which is added to a deposit of 5% of the debt amount. Expiration depends on the joining date.
Adhering to the São Paulo Agreement is quite simple, the taxpayer makes the electronic application and chooses the debts they want to transact. The request can be made via the website www.dividaativa.pge.sp.gov.br.
