The president of the Chamber declared that congressmen need to “raise the bar” so that the country can reduce judicialization

The president of the Chamber of Deputies, Arthur Lira (PP-AL), defended this Saturday (27.Apr.2024) limiting who can file an ADI (Direct Action of Unconstitutionality) with the STF (Supreme Federal Court). According to the congressman, the fact that the appeal can be proposed by “any entity, person or political party in Brazil” represents a “cancer”.

“We have a cancer in Brazil called Direct Action of Unconstitutionality, proposed by any entity, any person, any political party in Brazil with a representative in the National Congress”said the president of Casa Baixa at the opening ceremony of the “89th Expozebu in Uberaba“, in Minas Gerais.

Lira said that congressmen must have “courage to face the issue” so that fewer issues are judicialized and more discussed by those who “have power of attorney from the people to represent them”.

The president of the Chamber questioned the disproportionality of people involved in the appeal decision process. “What’s the point of having a project with 400 votes in the Chamber plenary and a congressman filing an ADI and a minister issuing an injunction?”declared the deputy.

On Thursday (April 25), Supreme Court Minister Cristiano Zanin issued an injunction that suspends sections of the tax relief law for 17 sectors of the economy, in response to a request from the AGU (General Attorney’s Office). Minister Luiz Fux presented a request for review (more time for analysis) on Friday night. It will be 90 days.

Law 14,783 of 2023 had been approved by the Federal Senate in October. Despite not having been mentioned by Lira, the issue bothered the president of the Federal Senate, Rodrigo Pacheco (PSD-MG), who filed an appeal on Friday (26 April) to revoke Zanin’s decision.
