Rogério Marinho (PL-RN), leader of the opposition in the Federal Senate, stated that the Brazilian Bar Association (OAB) commits a “worrying deviation from its institutional mission” by questioning federal deputy Marcel van Hattem (Novo-RS) for a speech made by the parliamentarian in the Chamber last Friday, 25th.

On that occasion, van Hattem declared in the gallery that the OAB is an “accomplice” of the Minister of the Federal Supreme Court (STF) Alexandre de Moraes “in the end of the world investigations” as was “revealed” by Twitter Filles Brasil.

“It is with deep concern that we are aware of the announcement by the president of the Brazilian Bar Association,” declared Marinho, in a statement. “The inviolability of a parliamentarian in his opinions, words and votes is a cornerstone of our democracy, as guaranteed by the federal constitution in article 53.”

The opposition leader explained that the judicial interpellation works as a request for explanations in court, which serves as a preparatory action for “the filing of a future criminal action in the context of crimes against honor.”

“The interpellation aims to intimidate parliamentary actions, silence and gag a deputy”, he stated. He highlighted that the deputy “only gave his opinion in the chamber’s gallery about these incontrovertible facts” of the OAB.

Rogério Marinho also recalled that the institution filed a public civil action in 2021 against the Order of Conservative Lawyers of Brazil (OACB), in addition to having “asked” Alexandre de Moraes in 2023, “in a confidential investigation, for measures against the OACB.”

“As said by deputy Marcel van Hatten, the OAB has been conniving and participating in the abuses of authority and unconstitutionalities perpetrated by endless investigations,” he stated.

The senator declared that the OAB must “reconsider its position and seek an approach that is in harmony with the democratic values ​​that we all swore to defend.”

“Ideas and opinions should not be silenced, even when indigestible. The OAB’s mission in life is to defend the rostrum of the chamber of deputies with the same dedication that it defends the rostrum of the courts, because the word is the greatest vehicle of democracy”, added the parliamentarian.

State of exception

In the same note, the leader of the opposition in the Senate stated that “for 5 years Brazil has been living with typical episodes of a state of exception.” He gave Bill (PL) 2630 of 2020 as an example of this.

Van Hattem accuses OAB of being Moraes’ ‘accomplice’

Federal deputy Marcel van Hattem accused the OAB of being “accomplice” of Alexandre de Moraes in “abuses of authorities” committed by the minister. He also said that the institution assisted the magistrate by requesting “the persecution of fellow lawyers” in the end-of-the-world inquiries.
