Compensation for death on duty has not been paid to criminal police officers in Rio since 2019 | Public server

Since 2019, the State Secretariat of Criminal Police of Rio de Janeiro (Seap) has not paid any compensation for the death on duty of a criminal police officer. According to Seap, the reason is the lack of contractual coverage under a life insurance policy.

However, the justification contradicts state decree no. 41,505, of 2008, which determines that the State is responsible for paying the special benefit – of a compensatory nature – in a single installment worth R$100,000 to the employees’ dependents. The payment is only valid upon death during the exercise and as a result of the duties of the public servant.

Furthermore, Seap is the only one, among those focused on Public Security, that does not consider death due to Covid-19 as an accident on duty, a configuration determined by decree no. 47,038, of 2020. The compensation portion for these cases also It is worth R$ 100 thousand.

According to data from the Criminal Police Union of the State of Rio de Janeiro, installments were not paid to more than 131 families of criminal police officers who died or were partially or permanently disabled due to death on duty. As for cases of Covid-19, there was a lack of support for the families of eleven police officers who were victims of the disease.

“This situation came to light when the Union requested information from Seap about the process of contracting Life Insurance for State Criminal Police Inspectors”, highlights Sindsistema.

According to the union, when the deaths occurred during the pandemic, Seap did not guide the dependents of criminal police officers in the correct way.

“The secretariat claimed that it provided institutional assistance to family members in the administrative procedures that should be adopted, but, on the contrary, the families were not correctly advised on the request for the Compensation Benefit, and the Inquiries were archived without any practical solution”, he concludes.
