The majority partner of SAF Botafogo, John Textor, was suspended for 45 days and fined R$100,000 by the full court of the STJD due to offenses made in the defeat to Palmeiras, in 2023. Because he had already served a part last year , the North American will, in fact, be punished for 17 days.

The verdict was established by a majority of the auditors. This decision was made as a last resort and therefore cannot be appealed. The American has already served 28 days and has 17 more to complete his sentence.

Textor was reported three times under article 243-F (offense to honor) and once under 258-B (invading a place designated for the referee team or the match venue). Therefore, it falls under article 184 (when the agent commits two or more infractions, the penalties accumulate).

There were 30 days in 243-F, with a fine of R$100,000, and another 15 in 258. Two of the complaints in 243-F were grouped together. In addition to the maximum punishments, the American could be suspended for up to 360 days.

The rapporteur of the process, Mauricio Neves Fonseca, voted for a 105-day suspension and a fine of R$75,000being 90 days and the financial fine for offenses against 243-F and 15 days for 258. And he was accompanied by auditor Paulo Feuz.

Textor’s defense claimed that the American businessman had the right to enter the field, as he had a credential, therefore there was no invasion. According to reports, he entered the field to pray with the team.

They also argued that it was just one action and there should not have been several complaints in 243-F. Fact questioned by auditors.

STJD vice-president Felipe Bevilacqua voted for a milder punishment, considering that John Textor is a first-time offender, 30 days and R$75 thousand for 243-F and 15 for 258, totaling 45 days and R$75 thousand. Auditor Luiz Felipe Bulus agreed with the divergence. President José Perdiz agreed with this application of the articles, but differed on the size of the punishment, voting for 55 days in total.

Auditor Mauro Marcelo opted for a third line, absorbing the invasion complaint in one of the 243-F and defining 25 days and R$50 thousand for each of the infractions of this article, totaling 50 days of suspension and R$100,000 fine. Auditors Sergio Martinez and Mauro Marcelo followed the second divergence.

Initially, Textor was punished for 30 days preventively. After the trial, the suspension increased to 35 days, but Botafogo managed to obtain a suspensive effect so that he could follow the final stretch of the Brasileirão. The case is now back to trial.

This is just one of the cases currently in court against the American. He was also denounced for not presenting the evidence of match-fixing that he claimed to have. This was scheduled for the 1st disciplinary commission, but, due to another request from the STJD auditor, it was postponed and there is still no date for it to be judged in the first instance.

The third case refers to Textor’s speech saying that players manipulated results in Palmeiras games against São Paulo and Fortaleza in recent years. This is in the investigation phase. The clubs involved filed an Unnamed Measure and Notice of Infraction against the American director of Botafogo.
