Santos is confident of reaching an agreement with coach Fabián Bustos to overturn the transfer ban imposed by FIFA. The Argentine demands US$1.2 million from the club (around R$5.9 million), but, according to the Peixe board in an official statement, the value of the share fell to R$4 million.

In an excerpt from the note, the club states that “the former coach requested a fine of around R$6 million, for unilateral termination of the employment contract. After appeals from the club, FIFA and CAS decided to reduce the value of the compensation to around R$4 million.”

The debt covers the period between dismissal, in July 2022, and the end of 2023, when his contract would end. Bustos played 28 matches as coach of Peixe, with eight wins, 12 draws and nine defeats. The case is under the responsibility of the legal department.

Also according to the note, as soon as President Marcelo Teixeira’s management learned of the issue, it began conversations with Bustos and his staff to reach an agreement. As excerpt:

“As soon as it was notified, through the Legal Department, also aiming to avoid further damage to the club’s image, the Santos began negotiating an agreement with the former coach. The understandings are evolving satisfactorily, indicating a quick solution to the problem that occurred during the administration of former president Andres Rueda.”

Due to the transfer, goalkeeper Gabriel Brazão, recently signed and with a contract already signed, will not be able to be registered for Santos in the Campeonato Paulista. The club has not yet announced the arrival of the archer. Jorge, hired and still without appearing at the IDB, is experiencing a similar situation.

Bustos was hired on February 25, 2022, with a contract until the end of 2023. According to Santos, the contract did not provide for a fine for unilateral breach and there was a verbal agreement that there would be no charges if one of the parties opted for early termination.

The Argentine ended up being fired months later, on July 7 of the same year, after Peixe was eliminated by Deportivo Táchira, in Vila Belmiro, in the round of 16 of the Copa Sul Americana.

The coach was hurt by the way the situation was handled by then president Andres Rueda: there was a promise of reinforcements arriving that never materialized. In addition to a commitment, according to Bustos’ staff, that he would be guaranteed the position.

The hurt motivated a compensation action against the club, the case ended up dragging out in FIFA’s Dispute Resolution Chamber and, finally, Santos ended up punished to resolve the issue.

“O Santos Futebol Clube was informed by FIFA that it has a Transfer ban, a measure that prevents the signing and registration of new players. The “Transfer ban” is an administrative punishment that FIFA applies to clubs for non-payment of international transfers.

The decision stems from a lawsuit filed by coach Fabian Bustos, who worked at the club from March to July 2022, under former president Andres Rueda.
