The Supreme Court of Sports Justice (STJD) marked the judgment of eight players involved in the match-fixing scandal to favor bettors in Brazilian football.

The athletes, cited by Operation Penalty Maximum II of the Public Ministry of Goiás, were summoned to testify on June 1, at 11 am (Brasília time), in the plenary of the STJD, in Rio de Janeiro.

Meet the players and complaints

Six players were denounced in articles: 191, III of the CBJD; 243, §1 of the CBJD; and 243-A, sole paragraph of the CBJD with article 184 of the CBJD:

  • Eduardo Bauermann (Santos);
  • Fernando Neto (former Operário-PR, today at São Bernardo);
  • Igor Cariús (ex-Cuiabá, today at Sport);
  • Kevin Lomonaco (Red Bull Bragantino);
  • Moraes (former Juventude, currently at Aparecidense-GO);
  • Paulo Miranda (former Juventude, currently without a club).

The players mentioned above can be punished with a fine of R$ 100 to R$ 200 thousand, suspension of 180 to 1080 days, and banishment from football if they are judged as repeat offenders.

Two players were denounced in articles: 191, III of the CBJD, art. 242, sole paragraph of the CBJD, 243, §§1 and 2 of the CBJD, and art. 243-A, sole paragraph of the CBJD with art. 184 of the CBJD

  • Gabriel Tota (former Juventude, today at Ypiranga-RS);
  • Matheus Gomes (without club).

The players mentioned above can be punished with a fine of R$ 100 to R$ 200 thousand, suspension of 180 to 1080 days, and banishment from football.

The articles of the complaint

Article 184

When the agent, through more than one action or omission, practices two or more infractions, the penalties apply cumulatively.

Article 191

Fail to comply, or make compliance difficult:

I – of legal obligation; (B.C).

II – deliberation, resolution, determination, requirement, requisition or any normative or administrative act of the CNE or of the sports administration entity to which it is affiliated or linked; (B.C).

III – regulation, general or special, of competition. (B.C).

PENALTY: fine, from R$ 100.00 (one hundred reais) to 100,000.00 (one hundred thousand reais), with a deadline set for compliance with the obligation.

Article 242

Giving or promising undue advantage to a member of a sports entity, manager, coach, athlete or any natural person mentioned in art. 1, § 1, VI, so that, in any way, it influences the result of the match, competition or equivalent. (Wording provided by CNE Resolution No. 29 of 2009).

PENALTY: fine, from R$ 100.00 (one hundred reais) to R$ 100,000.00 (one hundred thousand reais), and elimination.

Single paragraph. The intermediary will incur the same penalty.

Article 243

Deliberately acting in a way that is detrimental to the defending team. – 56 – PENALTY: fine, from R$ 100.00 (one hundred reais) to R$ 100,000.00 (one hundred thousand reais), and suspension of one hundred and eighty to three hundred and sixty days. (NR).

§ 1 If the infraction is committed upon payment or promise of any advantage, the penalty will be suspension of three hundred and sixty to seven hundred and twenty days and elimination in case of recurrence, in addition to a fine of R$ 100.00 (one hundred reais) to BRL 100,000.00 (one hundred thousand reais). (NR).

§ 2 The author of the promise or advantage will be punished with a penalty of elimination, in addition to a fine, from R$ 100.00 (one hundred reais) to R$ 100,000.00 (one hundred thousand reais). (NR).

Article 243-A

Acting contrary to sporting ethics in order to influence the result of a match, competition or equivalent. (Included by CNE Resolution No. 29 of 2009).

PENALTY: fine, from R$ 100.00 (one hundred reais) to R$ 100,000.00 (one hundred thousand reais), and suspension from six to twelve matches, events or equivalent, if practiced by an athlete, even if substitute, coach, doctor or member of the technical committee, or for a period of one hundred and eighty to three hundred and sixty days, if practiced by any other natural person subject to this Code; in case of recurrence, the penalty will be elimination. (Included by CNE Resolution No. 29 of 2009).

Single paragraph. If the intended result is achieved from the procedure, the adjudicating body may annul the match, test or equivalent, and the penalties will be a fine, from R$ 100.00 (one hundred reais) to R$ 100,000.00 (one hundred thousand reais) , and suspension of twelve to twenty-four matches, competitions or equivalent, if practiced by an athlete, even if a substitute, coach, doctor or member of the technical commission, or for a period of three hundred and sixty to seven hundred and twenty days, if practiced by any another natural person subject to this Code; in case of recurrence, the penalty will be elimination.
