The Superior Electoral Court (TSE) unanimously denied this Thursday (1st) the candidacy of former federal deputy Roberto Jefferson for the Presidency of the Republic. The PTB, Jefferson’s party, will be able to present a new candidate within 10 days, if it chooses.

The Electoral Public Ministry contested the candidacy on August 18. According to the MP, the politician is ineligible until December 2023 for having been convicted by the Federal Supreme Court (STF) in 2012, in the monthly allowance trial.

Roberto Jefferson’s sentence was pardoned in 2016, but the Public Ministry argued that this does not affect the “side effects” of the conviction – that is, that the pardon did not restore the politician’s ability to run.

The request’s rapporteur, Minister Carlos Horbach, stated that the pardon granted does not prevent the effects of Jefferson’s ineligibility. “The pardon is intended to extinguish the primary effects of the conviction, while the secondary effects persist,” he said.

PTB launches Roberto Jefferson’s candidacy for the Presidency of the Republic

Jefferson was announced by the PTB as a candidate for the presidency on August 1 after the national convention, in a hotel in Brasília. The politician did not attend the event because he is under house arrest. He declared to the court to have BRL 745,323.41 in assets.

The ticket registered by the party has Father Kelmon (PTB) as a candidate for vice president. Kelmon’s candidacy record was approved by the TSE.

The former deputy was detained by the Federal Police in August 2021 by order of the Minister of the Federal Supreme Court (STF) Alexandre de Moraes, as part of the investigation into an alleged criminal organization acting on social media to attack democracy.

In January of this year, Moraes responded to a request from the former deputy’s defense and allowed him to comply with house arrest.

In a recorded video, Roberto Jefferson defended the candidacy as a way to fill “some niches of options for the right-wing electorate”. However, he said he did not “inhibit” PTB members from supporting the re-election of Jair Bolsonaro (PL).

In the same session this Thursday, the TSE ministers unanimously approved the registration of the PDT’s candidacy for the Planalto Palace.

The registrations of Ciro Gomes, candidate for president, were granted; and Ana Paula Matos, candidate for vice president.
