The Senate approved this Wednesday (8) the project that determines the return of insurance charges to cover compensation for victims of traffic accidents, previously known as DPVAT.

In a close vote, 41 senators were in favor of the text, the minimum necessary for approval. The project will now be sanctioned by President Lula (PT). See below how each senator voted.

Payment of the new insurance, which will take place once a year, will be mandatory for car and motorcycle owners.

The value of the fee and the date of the first payment have not yet been defined, but the government estimates a fee between R$50 and R$60, starting in 2025.

According to Caixa, the resource was only sufficient to cover accidents that occurred until November 14, 2023. Compensation payments for accidents that occurred after that date are suspended because the bank was awaiting approval of the project by Congress.

The insurance will be called Compulsory Insurance for the Protection of Traffic Accident Victims (SPVAT) and will work as follows:

  • Payment will be mandatory for anyone who has a car or motorcycle. A common fund is created to reserve contributions and the amounts will be used to cover compensation for death or disability, paid to people who suffer accidents;
  • the money will also be used to reimburse expenses for medical treatment, physiotherapy and prosthetics if these services are not available, via SUS, in the municipality;
  • The insurance will cover funeral expenses and professional rehabilitation for people with disabilities. Anyone who is already covered by private insurance and a health plan will not be able to receive assistance;
  • The values ​​of both the insurance rate and compensation are yet to be defined. SPVAT payment may change depending on the type of vehicle;
  • The driver who does not pay the mandatory insurance will be subject to a fine for a serious infraction. President Lula can veto this point;
  • Anyone who suffered an accident or the partner and heirs of the victim, in the event of death, will be entitled to compensation. Even if the vehicles involved in the accident are illegal – that is, if the owners have not paid the insurance – the victims will have access to resources;
  • payment of compensation must occur within 30 days;
  • vehicle licensing will only be granted upon payment of the SPVAT, as well as the transfer of ownership and the cancellation of the car’s registration;
  • Caixa will collect the insurance, manage the fund and analyze compensation claims. The bank may hire third-party companies to assist in the operation. The resources to pay companies will come directly from the fund;
  • states can enter into an agreement with Caixa so that the SPVAT payment can be made together with the licensing or the Motor Vehicle Ownership Tax (IPVA);
  • States that charge may receive up to 1% of the amount collected;
  • states and municipalities that offer collective public transport will still receive 35% to 40% of the money raised;
  • According to Caixa, compensation refers to accidents involving different types of vehicles. Examples are: private cars, taxis, rental cars, buses, minibuses and capacity with or without freight charges, motorcycles, scooters, trucks, pick-up trucks with a load of up to 1,500 kg, earthmoving machines.
