The Regional Electoral Court in Pernambuco (TRE) ordered the removal of inserts with the participation of former President Lula (PT) in advertisements for the Pernambuco government candidate Danilo Cabral (PSB) on television and radio. According to the decision, the PT’s appearances extrapolate 25% of the time allowed for “supporters” in advertising.

The decision was handed down by the auxiliary electoral judge Rogério Fialho. The judge also determined a fine of R$ 1 thousand for each new exhibition of the material. The contested inserts are 30 seconds long and aired on August 30th and 31st.
In them, according to the judge, Lula appears throughout the play asking for support for the candidate for the government by the Popular Front. In this year’s elections, the PT and PSB are linked nationally and in Pernambuco.
The judge recalled that the insertions are reserved for the candidate for governor and, therefore, the time allocated to the participation of supporters must be, at most, 25%. This is provided for by the Law on Elections, enacted in 1997.
“In a 30-second video, Luiz Inácio Lula da Silva, the candidate for the Presidency of the Republic, was made available with audio, voice and subtitles, as a supporter of the candidate for the majority position of governor of the state of Pernambuco, Mr. Danilo Cabral, the entire time of the play”, reads the decision.
The determination complies with a request made by the candidate for the government Raquel Lyra (PSDB), made jointly by the PSDB-Cidadania federation. The decision is preliminary and, therefore, it is possible to appeal to the full TRE.
Judge Rogério Fialho ordered that Danilo Cabral, the Popular Front and TV and radio companies be summoned to refrain from broadcasting irregular propaganda.
