The Public Ministry of Tocantins (MPTO), through the Geotechnology Laboratory of the Operational Support Center of the Public Prosecutors with environmental activities (LabGeo/Caoma), concluded the first survey of the incidence of forest fires that occurred since the beginning of the the most critical period of drought this year, to support the work of the Public Prosecutor’s Office and the Environmental Task Force in 2022.

The issuance and validity of controlled burning authorizations throughout the State of Tocantins are suspended from July 27 to October 15, 2022 by Ordinance no. 112/2022 of the Instituto Natureza do Tocantins (Naturatins), published in the Official State Gazette on August 28.

The first information collected from databases and satellite images, analyzed from July 27 to August 15, demonstrate the existence of 386 occurrences in rural properties, covering an area of ​​81,800 hectares and covering 53 municipalities in Tocantins.

The Public Ministry’s analysis is carried out annually and covers all the municipalities in Tocantins, enabling the identification of burned areas, rural properties and the respective persons responsible.

From the data collected, technical pieces are produced for forwarding to the Regional Environmental Prosecutors’ Offices and the Environmental Task Force. The methodology used by LabGeo/Caoma also includes the history of previous years, enabling the detection of fires and illegal fires in the same properties in the years 2020, 2021 and 2022, with 41 rural properties having been observed in the first half of August. use of fire consecutively in these three years.

The survey carried out by Caoma, with the generation of maps from satellite images and official databases, will enable ministerial action in the face of those responsible, aiming at the accountability of identified offenders, which may occur in the administrative, civil and criminal fields.

Without prejudice to civil liability, through the imposition of fines and/or indemnities, such conduct may constitute an administrative infraction, punishable by a fine, under the terms of Decree n. 6,514/98, as well as environmental crime, as provided for in article 41 of Law no. 9.605/98, punishable with two to four years imprisonment (in the intentional modality) and from six months to one year, if resulting from imprudence, malpractice or negligence of the person responsible (guilty modality).

Evaluation

The coordinator of Caoma, Attorney General José Maria da Silva Júnior, explained the context of the analysis of illegal forest fires and burns: “geotechnologies applied to the monitoring of illegal practices in the use of fire are being improved year by year, enabling greater agility of state bodies to hold offenders accountable. This improvement made it possible to bring the work of LabGeo/Caoma forward to shortly after the beginning of the prohibited period, in order to speed up the administrative and/or judicial actions to be implemented”. According to José Maria, the monitoring that previously took place after the end of the prohibited period will be carried out continuously throughout the dry season, with the issuance of partial reports and immediate delivery of the technical parts to the Prosecutors of Justice.
