The doctor Elder Rocha Lemos (CRM/MS 3151 and CRM/MT 9910) had his registration suspended for 30 days after being punished by the CRM-MS (Regional Council of Medicine of Mato Grosso do Sul). The doctor allegedly violated articles 38, 40 and 87 of the Code of Medical Ethics, disrespecting the modesty of patients. The publication was published in the Official Gazette of the Union this Thursday (1st).
Elder has a criminal record for rape. According to the incident report, the doctor would have attended to teenagers, always asking them to enter unaccompanied. In 2017, one of them reported to social workers that she was vomiting when she was seen.
The doctor reportedly asked her to take off her shirt and felt her breasts. He asked her to return the next day without her boyfriend, when he massaged her and invited her to travel with him. The case is registered as rape, as the girl was 14 years old at the time.
The CRM complaint arises from the ethical-professional process nº 34/2018. Now, Elder is prevented from practicing medicine for a period of 30 days, from 9/12/2022 to 10/11/2022, due to violation of the current Code of Medical Ethics.
According to the decision, Elder would have ‘disrespected the modesty of anyone under his professional care’, ‘taken advantage of situations arising from the doctor-patient relationship to obtain physical, emotional, financial or any other advantage’ and ‘left to prepare a readable medical record for each patient’.
The decision does not state whether there is a direct relationship between the case of rape in the service registered by the Civil Police in 2017 and the process, initiated in 2018. Mediamax newspaper contacted the doctor so that he could comment on the case, but the calls were not answered. The space remains open for demonstration.
