247 -The family of merchant Cleriston Pereira da Cunha, who died in the Papuda Penitentiary Complex (DF) in November 2023, after the coup attacks on January 8, filed a criminal action in the Federal Supreme Court (STF) against minister Alexandre de Moraes. The widow and her two daughters accuse the magistrate of crimes ranging from ill-treatment to qualified torture, demanding sentences that can reach 31 years in prison, highlights journalist Mônica Bergamo in her column for the newspaper Folha de S. Paulo.

Cleriston Pereira da Cunha, aged 46, died of a sudden illness while under preventive detention in Papuda, receiving medical care. The family claims that the trader was subjected to inhumane conditions and holds Minister Moraes directly responsible for his death.

The action, signed by lawyer Tiago Pavinatto, former presenter of Jovem Pan News, was filed with the STF and requires not only the arrest of the minister, but also his removal from court duties, in addition to the payment of compensation for moral damages. Cleriston’s request for provisional release, which was being analyzed by Minister Moraes, is mentioned as a crucial element in the family’s argument.

According to the prosecution, the merchant’s death occurred in a preventive detention considered “manifestly illegal” and under the full responsibility of the magistrate. The family alleges that Moraes, abusing his power, assumed the risk of Cleriston’s death by maintaining unfavorable conditions in prison.

The action highlights that the trader was unable to carry out basic activities, such as walking to sunbathe, highlighting the physical and mental suffering to which he was subjected. The lawyer argues that the minister’s persistent omission exceeds the devaluation foreseen by the legislator in the crime of ill-treatment.
