A 23-year-old man was sentenced to 61 years, eight months and 13 days in prison. The sentence concerns the crimes of rape of a vulnerable person committed in the context of domestic violence, attempted rape of a vulnerable person also in the context of domestic violence and facilitating access by minors to pornographic content. To commit the crimes, the defendant took advantage of his status as the victims’ brother, taking advantage of the authority he exercised over them to commit sexual abuse.
It is stated in the complaint presented by the Public Ministry of Santa Catarina (MPSC) through Public Prosecutor Pedro Lucas de Vargas that, between December 2020 and June 2021, the defendant performed libidinous acts numerous times with his two sisters, aged nine and 15. years at the time of the events, in addition to raping his older sister.
The crimes were committed inside the family home. The incident was reported to the police authorities after the sisters reported what was happening to their mother, who contacted the police station.
As reported by the Public Prosecutor, the crime of rape was only not committed against the younger sister due to circumstances beyond the defendant’s control, considering that, on every opportunity in which he attempted to commit abusive sexual practices with the minor, , the victim managed to escape to other rooms of the residence.
The acts were carried out under threat. The convict said that he would kill his sisters and other family members if they did not allow the practice of libidinous actions. The defendant was also convicted of facilitating his nine-year-old sister’s access to pornographic content, as he presented the child with pornography images trying to naturalize the practice, with the intention of abusing her.
It should be noted that the facts characterize a situation of domestic and family violence against women, for reasons of the female sex and since the victims are sisters of the accused, who used the domestic and family relationship to commit the crime. . The completion of the crimes was confirmed through an expert report and testimonies from people close to them and the victims themselves.
The defendant was on the run for two years. He was placed under preventive detention in June 2021 following a request from the police authority and a favorable statement from the Public Prosecutor’s Office. However, he remained at large, only being located in May of this year, when the arrest warrant was served in Rio de Janeiro.
