TSE decision could affect Brasilia residents

In a decision that could affect parliamentarians from Brasilia, including three districts, federal deputy from São Paulo Marcelo de Lima Fernandes had his mandate revoked by the Superior Electoral Court in a session that lasted until the night of November 7th.

He was elected in 2022, with more than 110 thousand votes, for Solidariedade, but transferred to PSB. The sentence opens the possibility for former deputy Paulinho da Força, who became the party’s first deputy with 60,000 votes, to assume the position, but the final decision will be made by the Regional Electoral Court of São Paulo.

The SD argued that the parliamentarian left the party without presenting a just cause, as required by electoral legislation. Marcelo Lima countered the accusation, arguing that, as the SD did not meet the performance clause in the last elections, there is just cause for the politician to change his party without being punished with the loss of his mandate.

The party admits that it did not reach the clause, but later recovered its conditions by incorporating PROS, in February 2023. Giving change, Marcelo Lima stated that he abandoned Solidariedade before this merger and, therefore, would have just cause for party disaffiliation . The SD has no weight in Brasília, but four parliamentarians from Brasília have already switched parties due to exactly these conditions.
