In 2016, the 1st Panel of the STF accepted the complaint and placed Bolsonaro in the dock. However, the progress of the criminal action was suspended in 2019, when he assumed the presidency.

After leaving Planalto this year, the criminal action was sent to the first instance. The Public Ministry stated that it was no longer possible to punish Bolsonaro due to the statute of limitations.

The MP’s thesis was accepted by judge Francisco Oliveira, who archived the case. According to the judge, the three-year statute of limitations expired, even considering the four-year period in which the action was suspended while Bolsonaro was in office.

Considering the period of time between 6/21/2016 (date of receipt of the complaint at the STF) and 12/31/2018 (date immediately prior to the start of the defendant’s presidential term) added to that between 1/1/2023 (first day after the end of the presidential term) until today, I note that more than three years have passed, with no other legal solution other than the recognition of the State’s punitive prescription.
