
The Federal District Court filed this Wednesday (8) the criminal action against former president Jair Bolsonaro for inciting the crime of rape allegedly committed against deputy Maria do Rosário (PT-RS), in 2014, when he was deputy for Rio de Janeiro.
The decision was given by judge Francisco Antonio Alves de Oliveira, from the 2nd Special Criminal Court of Brasília. According to the judge, considering that crimes with a maximum penalty of less than one year prescribe in three years and that the conduct attributed to Bolsonaro would have a maximum penalty of six months in detention, “there is no other legal solution other than the recognition of the punitive prescription of State”.

According to the complaint, the crime would have happened during an interview in December 2014. Bolsonaro would have said “she doesn’t deserve it, because she’s very bad, because she’s very ugly, she’s not my type, I would never rape her. I’m not a rapist, but, if he were, he wouldn’t rape, because he doesn’t deserve it”, referring to congresswoman Maria do Rosário.
In June 2016, the First Panel of the Federal Supreme Court (STF) received the complaint. In February 2019, Minister Luiz Fux suspended the action due to the fact that Bolsonaro had been elected president. In June of this year, after Bolsonaro was no longer president, Minister Dias Toffoli referred the action to one of the Criminal Courts in Brasília. The Public Prosecutor’s Office decided to close the action “as it understands that the punitive claim is time-barred.”
“I consider that the defendant benefited for the time in which the process took place. Even so, the court has already sentenced him in the civil case to pay compensation, which he distributed to entities combating violence against women”, stated Maria do Rosário.
