In response to a request from the Workers’ Party (PT), by four votes to three, the Superior Electoral Court (TSE) determined, this Thursday (22/9), that Instagram and TikTok remove, within 24 hours, two videos that accuse the PT government of distributing to children’s schools a book with inappropriate content for students. At the time, the Ministry of Education (MEC) reported that the publication was not even included in the National Textbook Program (PNLD) and the National School Library Program (PNB).

One of the videos shown is from an old interview with the then federal deputy and current president, Jair Bolsonaro (PL), in 2018. If the videos are not removed, social networks are subject to a daily fine of R$5,000.

The former rapporteur of the case, minister Raul Araújo, denied the party’s request and ministers Carlos Horbarch and Sérgio Banhos followed the vote.

Minister Alexandre de Moraes, on the other hand, fully granted the injunction for the removal of the videos from the internet, noting that the videos have been circulating since 2018 and, therefore, effective and immediate action by the TSE is necessary so that the content does not continue on the internet, even that are identified with the label “Fake news”.

“The very serious, somber scenario reinforces these biased behaviors, fake news and misinformation that the Superior Electoral Court has been fighting so rigorously. There are two fights: all kinds of violence (physical or moral) and the fight against disinformation. The voter cannot be coerced physically, morally, and cannot be fraudulently and biasedly misinformed,” he defended.

On October 15, 2018, it was recorded that the Ministry of Education had already denied the information on different occasions, stating that the book was never part of the textbooks distributed or recommended by the institution. Even earlier, in 2013, the Ministry of Education had already replied to the press that the information about the alleged recommendation was wrong.

Minister Carmen Lúcia said that the premise is that “lying is not worth it”. “In a democratic electoral game, a lot is worth a lot, including freedom of expression. In the public square, on a platform, the extent of freedom is validated and the freer the better. But lying is not worth it. The starting point of this case is the lie. The kidnapping of the truth is not worth it”.
