In a new decision, federal judge Friedmann Anderson Wendpap, from the 1st. Federal Court of Curitiba, gave five days for Viapar to make a conclusive statement on the feasibility of completing the Arapongas Road Contour. The deadline ends next Friday (24). A similar decision had already been taken by the same judge in July, but the resumption of works ended up being postponed. The judge’s decision comes in a Public Civil Action in which he also analyzes the long dispute involving Viapar, the state government and the Department of Highways (DER).
In his new decision, the judge adds that, if so, Viapar must indicate the stages of the physical schedule that it can comply with immediately, given the release of 83.17% of the areas through which the road contour works will take place. The Federal Public Ministry has already proposed three actions against Viapar, which has committed to carrying out the three contours (Arapongas, Peabiru and Jandaia do Sul) within two years of acquiring possession of all areas necessary for the works. From then on, even when carrying out the works at Jandaia do Sul and Peabiru, a disagreement began between Viapar and DER regarding who would bear the costs relating to the expropriation process.
However, the judge has already refuted Viapar’s arguments to postpone the restart of works on the Arapongas Road Contour for longer, such as the lack of revenue due to the termination of the concession or a financial rebalancing that could allow it to bear the costs of expropriation. “It is still another important decision. We will wait for Viapar to respond and continue monitoring this process step by step, which is of extreme interest to Arapongas. We hope that now there will be a definition in this regard”, says Rafael Cita, who had been working as the Municipality’s Legal Attorney and is now in charge of the Government Secretariat. The Road Contour has an approximate length of 10 km and its updated cost is already estimated at around R$180 million.
