The prosecutor of the Public Ministry of Bahia (MP-BA), Nívia Carvalho Andrade, requested clarifications from the general director of the State Secretariat of Culture (Secult-Ba), Thiago Reis, in relation to the complaints made by cultural producers about the state notice of the Paulo Gustavo Law. According to information from the Correio newspaper, the producers allege several irregularities in the administration of the notice, including a lack of solid technical opinions, inconsistencies in the evaluation panels and difficulties in communicating with Secult. The complaint received support from the Vitória da Conquista subsection of the Brazilian Bar Association in Bahia (OAB-BA). The prosecutor requested explanations from Secult on these points, aiming to obtain preliminary information to consider the measures to be taken.

In response, Secult-ba stated that it will answer all questions asked by MP-BA, emphasizing that the management of the notices followed the same methodology as the Culture Fund’s notices, maintaining the transparency characteristic of its cultural promotion processes in the state . The note also clarified that the request made by the MP-BA is part of an administrative process, not involving judicialization of the management of PGBA notices. After denying the initiation of civil proceedings at the Public Prosecutor’s Office, the MP-BA opened the administrative process to request information.

The Paulo Gustavo Law (Complementary Law No. 195/2022) is legislation to encourage culture with federal resources, representing the largest direct investment ever made in Brazil’s cultural sector, with R$3.862 billion allocated to cultural projects across the country. The notices are evaluated on three criteria: content, technical feasibility and compliance with the Organic Law of Culture.
