The rapporteur includes a provision in the Anti-Drug Law to make explicit the duty of the prison health system to ensure treatment for drug addiction

The Health Committee of the Chamber of Deputies approved a proposal that includes, in Sisnad (National System of Public Policies on Drugs), the guarantee of treatment for users and drug addicts deprived of liberty.

The approved text is a substitute presented by the rapporteur, deputy Pastor Sergento Isidório (Avante-BA), to PL (bill) 3611 of 20, by deputy Sóstenes Cavalcante (PL-RJ), and his attachedPL 2546 of 21.

Originally, Sóstenes Cavalcante’s project suggested the creation of a national policy for the recovery of chemical substance addicts to be conducted in the Brazilian prison system.

Existing policies

Pastor Sergeant Isidório noted, however, that Brazil already has the Pnaisp (National Policy for Comprehensive Health Care for People Deprived of Liberty in the Prison System), established by Interministerial Ordinance 1 of 14.

Furthermore, stated the rapporteur, the country has Sisnad, which aims to articulate, integrate, organize and coordinate activities related to the social reintegration of drug users and addicts and the repression of unauthorized production and illicit drug trafficking. .

“This system has specific sections dedicated to the treatment of drug addicts, integrated into the Unified Health System (SUS). It also provides for the guarantee of health care services for drug users or drug addicts who are serving a custodial sentence.”said Pastor Sergeant Isidório.

“However, there is no mention of drug addiction treatment, which is something that can be improved.”

Anti-Drug Law

The rapporteur then decided to include in the Anti-Drug Law, which created Sisnad, a device to make explicit the prison health system’s duty to ensure treatment for chemical dependency.

“Such a measure improves the legal certainty of guaranteeing comprehensive health care, by excluding doubts that may exist in relation to the rights of those who are under the guardianship of the State.”

Processing

The project is underway in conclusive character and will also be analyzed by the Public Security and Combating Organized Crime commissions; and the CCJ (Constitution and Justice and Citizenship).
